LOWER UNIT WARRANTY POLICY & PROCEDURE 

 

LIMITED WARRANTY OF QUALITY OUTDRIVES

Effective October 15, 2015

 

WARRANTYAll warranty claims must be initiated by emailing Quality Outdrives. If your product is within the warranty period we will issue a return authorization, or RA number. Please package up the item as best as possible, using the original packaging if it is still available and write the RA number in large letters on the outside of the box. Customer is responsible for all shipping costs to Quality Outdrives. Once we’ve received the item, we will evaluate it to determine if the problem is indeed covered under the warranty. If it is, we will send out a replacement unit at no charge or we will repair the damaged unit when possible. Shipping of the repaired or replacement lower unit back to the customer is covered by Quality Outdrives (ground shipping within the 48 lower states in the U.S.) Additional charges for shipping to Alaska , Hawaii or international shipping may apply. If however, the item is not covered under the warranty, we can fix it at a discounted rate. In this case the customer would also be responsible for shipping both ways. We cannot honor the warranty on any items that have been disassembled or repaired by anyone other than Quality Outdrives. Impact damage caused by hitting an underwater obstacle or insufficient packaging is not covered under this warranty.
WARRANTY COVERAGE.
This warranty extends to the original purchaser only and commences upon receipt of product. Accordingly, this warranty is non transferable. Quality Outdrives warranties its products as follows:
•    Remanufactured Powerheads - One (1) Year
•    Refurbished Gearcase or Lower Unit Assemblies - One (1) Year
•    All other Refurbished Components - One (1) Year
•    New Powerheads - One (1) Year
•    New Gearcase Assemblies - One (1) Year
Any Part of this Quality Outdrives product, remanufactured or supplied by Quality Outdrives, and found in the reasonable judgement of Quality Outdrives to be defective in material and workmanship will be repaired or replaced by Quality Outdrives without charge for parts and labor. The product including any defective part therein must be returned to Quality Outdrives, freight prepaid, within the warranty period. Quality Outdrives will then execute the warranty procedures. After warranty claims are completed, Quality Outdrives will execute shipment, prepaid, back to the purchaser. Quality Outdrives 's responsibility in respect to warranty claims is limited to making the required repairs or replacements, and no claim of breach of warranty shall be cause for cancellation or revision of the contract of sale of any Quality Outdrives product. Proof of purchase will be required by Quality Outdrives to substantiate any warranty claim.
This warranty does not cover any product that has been subject to misuse, neglect, negligence, or accident or has been improperly maintained, operated, or installed. This warranty does not cover any damages to the product due to rust or corrosion. This warranty does not cover any product that has been altered or modified in any way. In addition, this warranty does not extend to repairs made necessary by normal wear, or by the use of other parts or accessories which, in the judgement of Quality Outdrives, are either incompatible or adversely affect the operation, performance, or durability of Quality Outdrives 's product. Quality Outdrives reserves the right to change or improve the design of any Quality Outdrives product without assuming any obligation to modify any previous Quality Outdrives product. All implied warranties are limited in duration to the specific warranty period.
All implied warranties, including merchantability, fitness for a particular purpose, or otherwise are disclaimed in their entirety after expiration of the specific warranty period. Quality Outdrives's obligation under this warranty is strictly and exclusively limited to the repair or replacement of defective parts, and Quality Outdrives does not assume or authorize anyone to assume for them any other obligation. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Quality Outdrives assumes no other responsibilities for incidental, consequential, or any other damages of any nature. Some jurisdictions do not allow this exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
This warranty gives you specific legal rights and you may also have other rights which may vary from jurisdiction to jurisdiction. In the event that a warranty claim is required outside the continental United States, with the exception of Alaska and Hawaii, there may be additional charges not covered under this warranty. These additional charges are the responsibility of the purchaser. Disassembly of any product sold by Quality Outdrives without prior approval will void your warranty.

VENUE FOR ENFORCEMENT. This Agreement is made in the State of Florida, and all by “QUALITY OUTDRIVES” are sold at its principal offices in Cape Coral, Florida. The limited warranties specified hereunder, and all rights and claims of user or buyer hereunder, must be enforced in the State of Florida. Venue for the enforcement of this Agreement and for the resolution of any disputes between “QUALITY OUTDRIVES” and its buyers or users, including all suits to construe the terms of this Agreement, shall be adjudicated in Lee County, Florida. In the event that buyer or user asserts any claims against “QUALITY OUTDRIVES”, under these warranty plans or otherwise, and in the event that such claims are not resolved through direct negotiations between the parties, then all such claims and disputes shall be subject to non-binding mediation in Lee County, Florida, as a condition precedent to buyer asserting any legal action against “QUALITY OUTDRIVES”. Said mediation shall be conducted by a certified mediator under the laws of the State of Florida, and each party shall be responsible for paying an equal share of all mediation costs. This mandatory mediation shall be a condition precedent to the filing of any legal action or lawsuit, and the terms of this Agreement shall be enforceable by any court of competent jurisdiction. 

GENERAL TERMS. The terms and conditions of the limited warranty plans set forth hereunder are a part of the bargain between the parties hereto, and are material to setting the price of sale of “QUALITY OUTDRIVES”'s products. The terms and conditions set forth hereunder constitute the entire agreement and transaction between the parties; and all prior discussions, negotiations, telephone conferences, dealings, course of conduct, and other relationships between the parties are hereby merged into this Agreement. This Agreement shall supersede all prior negotiations and dealings between the parties, and time shall be of the essence in construing the terms hereof. By concluding the transaction between the parties, buyer and “QUALITY OUTDRIVES” agree to all of the terms and conditions set forth herein above.

 

 

LOWER UNIT WARRANTY PROCEDURE

In the event that you experience a problem with your lower unit within 12 months, you will need to email our Warranty Department . Please have your invoice and serial numbers readily available.

 

Please ship the lower unit to “Quality Outdrives”, warranty department, (please call for shipping address).You will be responsible for shipping the lower unit back to “QUALITY OUTDRIVES”. International customers 

are also responsible for all shipping charges to and from “QUALITY OUTDRIVES”. Be SURE to fully insure your lower unit 

with your carrier for its full value. 

 

If you ship a complete stern drive, please send your drive to “QUALITY OUTDRIVES” in two halves (where applicable).

Do not send any additional parts with your drive (example: prop, anodes or other miscellaneous hardware) as

“QUALITY OUTDRIVES” cannot be responsible for it. 

 

“QUALITY OUTDRIVES” ships via ground service for all its warranted products. Request(s) to expedite shipments are 

the responsibility of the customer, along with any associated charges where applicable.

 

Upon receipt of the warranted unit, “QUALITY OUTDRIVES” will either repair or replace the product if it is a warranty related issue..

 

“QUALITY OUTDRIVES” will not ship a replacement lower unit or drive until the warranted unit has been received and inspected.

 

If you ship a complete sterndrive to “QUALITY OUTDRIVES” (upper and lower in a single container), it will be shipped 

back to you in two boxes.

“QUALITY OUTDRIVES” commits to make every effort to ship your replacement lower unit or drive within ten business days of 

receiving the warranty unit. If it will be more than two weeks, “QUALITY OUTDRIVES” will contact you.
